Legislature passes bill allowing for protective orders in dating relationships

SALT LAKE CITY — Despite protests that "roughhousing" teens could be subject to court orders, the Utah Senate gave final passage to a bill that enables Utahns 18 and older who are abused or threatened in dating relationships to seek protective orders.

Several lawmakers — Democrat and Republican — have proposed varying versions of the legislation dating back nine years in an attempt to address a gap in the code. Under Utah law, only spouses or cohabitants can seek such orders.
But in previous legislative sessions, the bills have been rejected over concerns that vindictive dating partners would lie to obtain protective orders or that people could be unfairly denied access to firearms while subject to protective orders.
On Tuesday, HB50, sponsored by Rep. Jen Seelig, D-Salt Lake City, passed the Senate by a vote of 24-4.

How to Divorce When You Can't Find Your Spouse

Although there are ways to divorce a missing spouse, typically the court will not endorse it until you have made all efforts to track down your spouse. It is typically better to locate your spouse then to try and divorce him without his involvement as Utah has limitations on this type of divorce.

In Utah you are required to notify your spouse that you are divorcing him since he has the right to contest the action and defend his interest. If you are unable to track him down you will need to ask the court for an alternative means to notify your spouse.

House purchased with undisclosed issues in contract

We contacted the seller and she remembered the repair of toilet but would not pay for repairs of floor. During that repair the plumber found crawl space had 30" of water in it and I had to pump it out. No apparent damage but Ifound a sump already in place on the far end of house and neighbors confirmed it being pumped out each spring. Now have water damage to floor in master bathroom from previous repair. None of this was not disclosed.

Answer: The failure to disclose should sound in contract, since it is failure to provide all the disclosures required by a written contract. In that case, the statute of limitations should be 6 years in Utah. However, if you believe that you have a claim, do not wait to go to an attorney--speak with one now.
